What does the Virginia Telephone Privacy Protection Act prohibit?

The Virginia Telephone Privacy Protection Act prohibits the following acts:

  • Making a telephone solicitation call to a telephone number on the National Do Not Call Registry.
  • Making a telephone solicitation call to a telephone number when a person at such telephone number previously has stated that he does not wish to receive calls from that company or person.
  • Failing to identify the caller by first and last name and the name of the person on whose behalf the telephone solicitation call is being made promptly upon making contact.
  • Failing to transmit the telephone number, and, when available by the telephone solicitor’s carrier, the name of the telephone solicitor.
  • Engaging in any conduct that results in the display of false or misleading caller identification information on the called person’s telephone.

What are the penalties for violating the Virginia Telephone Privacy Protection Act?

The VTPPA provides for damages in the amount of $500 for a first violation, $1,000 for a second violation, and $5,000 for each subsequent violation. If the court finds any violation to be willful, the court may increase the amount of any damages awarded for a first or second violation to an amount not exceeding $5,000.
